CNUE priorities for the year 2011 – contractual and company law in EU, succession and property of spouses regulations
The president of the Notaries Chamber of Lithuania Marius Stračkaitis participated on February 7 in Tallinn in a meeting with the President of the Notaries Council of the European Community (CNUE), an Austrian notary Rudolf Kaindl, and with the management of Estonian Notaries Chamber. R. Kaindl who started his cadence this year on January 1 arrived to Tallinn to present to notaries of the Baltic States order of business and priorities of CNUE lead by Austria.
“We are sure that position of notaries in European Community and CNUE activities shall be influenced by a decision of European Court of Justice that is going to be announced soon on violation of the European Community treaty – citizenship requirement for notaries,” – said the Austrian notary.
According to R. Kaindl, the order CNUE order of business for 2011 shall be significantly influenced by projects discussed and implemented by the European Commission which are directly connected with notaries. These are Single Market Act, European Community citizenship program and European Commission activities program for 2011. Especially important for notaries are the Succession Regulation Project, Rome III Regulation (on divorce), Brussels I Regulation and European Companies Law that have reached the stage of approval in the European Commission. Negotiations are planned on amendments of legislation connected with loans and pledge, legal regime of property of spouses, struggle with intensification of money laundering, development of European e-Justice portal and its connection with companies and land registries.
According to R. Kaindl, CNUE priorities for 2011 include implementation of three projects already launched or being started that are financed by the European Commission. These are: 1) internal Internet portal dedicated to legal regime of property of spouses, 2) annual European Notary Network program presupposing professional training initiative in the sphere of European law and filling the succession legal base portal www.successions-europe.eu, 3) creation of an Internet portal “European Notaries Catalogue” (this project is lead by Slovenia, partners – Austrian Notaries Chamber and CNUE).
R. Kaindl also informed that three big public notary events are planned this year: a European Notaries Conference to be held on April 7-8 in Salzburg (Austria) (the main topic is “200 years anniversary of Austrian General Civil Code and European contract law”), the third congress of CNUE in Brussels on June 28 and a conference on property of spouses issues prepared jointly with the European Commission.
Apart from the said events, CNUE is going to organize four sessions of both the General Assembly and Executive Board as well as several working groups’ sessions.
“We hope that notaries in the Baltic States will actively participate in the conference in Salzburg and the Brussels congress, because we have to stress the importance of the notary’s profession to the European Commission in order to ensure transparent and efficient business relations,” – said R. Kaindl.
During the meeting the president of Estonian Notaries Chamber Anne Saaber and the president of Lithuanian Notaries Chamber Marius Stračkaitis described in detail the situation of notaries in Estonia and Latvia, presented discussed legislative initiatives, relations with state institutions.
